Providing a fair and efficient hearing process for contested cases within the RRC's jurisdiction

EX PARTE COMMUNICATIONS

16 TEX. ADMIN. CODE § 1.7 (Ex Parte Communications):

  1. Ex Parte communications are prohibited in contested cases as provided in the APA and other applicable rules including the Texas Disciplinary Rules of Professional Conduct.
  2. Each party shall provide all other parties with a copy of all documents submitted to an examiner.
    1. The attachment of a certificate of service stating that a document was served on a party creates a rebuttable presumption that the named party was provided a copy.
    2. Failure to provide a copy to all other parties may result in rejection and return of the document without consideration.

What we do

The Hearings Division is responsible for scheduling, conducting, and preparing recommendations on hearings concerning oil and gas, gas utilities, pipeline safety, alternative fuels safety, and surface mining matters within the Commission’s jurisdiction. The Commission’s hearings are presided over by eight administrative law judges and eight technical examiners.

Filings

Filings pertaining to any docketed matter under review in the Hearings Division must be filed with our Docket Services section in Room 12-123 of the William B. Travis Building.

Pursuant to 16 TAC §1.22, filings may be done electronically. For dockets in RRC CASES,  Electronic filings should be uploaded by an authenticated user through the CASES portal. For dockets not in RRC CASES, filings may be sent to the following email address: Hearingsdivision.efile@rrc.texas.gov

Please note: Pleadings that conform with 16 Tex. Admin. Code §§ 1.1-1.131 will be entered as filed when received during normal business hours. Pleadings filed after normal business hours and accepted for filing will be file marked the next business day. Pleadings that fail to conform with 16 Tex. Admin. Code §§ 1.1-1.131 may not be accepted for filing. You will be notified if your filing is not accepted.
